Electric Bicycle (e-bike) US Federal Law

Federal law defines electric bicycles (e-bikes) as "low-speed electric bicycles" and categorizes them into three classes based on their top assisted speeds:

  • Class 1: The motor only assists the rider while pedaling, and stops assisting when the bike reaches 20 miles per hour
  • Class 2: The motor can be used to propel the bike without assistance, and stops assisting when the bike reaches 20 miles per hour
  • Class 3: The bike can reach speeds of up to 28 miles per hour

Federal law also states that:

  • Low-speed electric bicycles are consumer products
  • The Commission can create new or amended requirements for low-speed electric bicycles
  • Federal law does not take precedence over state traffic laws or vehicle codes

Many states have incorporated e-bikes into their traffic codes, but some states still have outdated laws. Licensing and registration requirements for e-bikes vary by state, and are often based on the e-bike's classification. For example, some states require a license for certain e-bike classes, while others require registration for certain classes.
